The Secretariat of Energy approved, through Resolution 264/2026 (Official Gazette, September 25, 2026), a specific framework for Out-of-Trend Demand (XDEM) in the Wholesale Electricity Market (MEM). The regulation applies to new projects and large-scale expansions—including data centers, artificial intelligence, mining, LNG, hydrogen, and other electricity-intensive activities—and imposes stricter obligations regarding contracting, firm capacity, planning, infrastructure, and technical performance.
