On April 1, 2026, the National Securities Commission (“CNV”) issued General Resolution No. 1124, thereby initiating the “Participatory Rulemaking” process regarding the “Draft General Resolution on Open-Ended Mutual Funds (ETFs).” In other words, the CNV has not yet approved a definitive framework for local ETFs, but rather has submitted for public consultation a regulatory proposal aimed at establishing a specific framework for open-end mutual funds that replicate indices through passive management, providing for their trading on secondary markets and setting conditions to ensure their proper functioning.
