Through Resolution 99/2026 (Official Gazette, April 23, 2026), the Energy Secretariat of the Ministry of Economy approved the inclusion of a new regulatory provision in the “Recovery of Fuel and Dispatch Costs” regime of the Rules for the Normalization of the Wholesale Electricity Market (MEM) and its Progressive Adaptation. It also ordered the removal of references to the Deliver or Pay (DOP) mechanism related to the unavailability of fuel declared by the generator
