On June 4, 2025, Decree 379/2025 was published in the Official Gazette, by means of which the National Executive Power (PEN) introduced a relevant amendment to Law No. 26,589, establishing the new “Pre-judicial Mediation Procedure in Health Matters” (PROMESA). According to the regulation and its annex, this reform aims at addressing the growing volume of health litigation through an alternative, specialized, agile and less costly pre-judicial instance, applicable to conflicts with social security and prepaid medicine companies.
