José Luis Zapata has been appointed a member of the Commission on Guarantees of the Regime that regulates the exercise of the right to strike in essential services.

José Luis Zapata, Partner of our Labour and Employent Area, has been appointed by the National Executive Branch (Decree 766/25) to join the Commission on Guarantees provided for in Article 24 of Law 24557.

This law regulates the exercise of the right to strike in collective labor disputes that could affect the normal provision of services involving activities that may be considered essential or of transcendental importance.

The law establishes that the Guarantees Commission shall be composed of five independent members of recognized technical, professional, or academic standing in the field of labor relations or constitutional law and with distinguished careers, proposed by the ARGENTINE INDUSTRIAL UNION, the GENERAL CONFEDERATION OF LABOR, the NATIONAL ACADEMY OF LAW AND SOCIAL SCIENCES OF BUENOS AIRES, and the NATIONAL INTERUNIVERSITY COUNCIL (C.I.N.). In turn, the National Executive Branch also appoints a representative and an alternate member.

The Guarantees Commission is granted the power to classify activities not covered by the regulation as essential services when the interruption of services could put the life, health, or safety of the population at risk.
